These conditions, and the documents to which they refer (the "Terms"), apply to the use of this website (the "Website") and of the connected services made available through it (jointly, the "Service").
The Terms contain important information on the rights and duties of anyone using the Website and constitute a binding agreement between the customer (the "Customer") and the operator. Any person who uses the Website or the Service, whether as a guest or as a registered holder of an account (the "Account"), accepts these Terms and every amendment published later. Anyone who does not accept them must not access the Service or use the Website. The website Lucky Boom (the "Casino", "Website", "Company", "We", "Us", "Our") is owned and operated by MAIREKE LIMITADA, a company incorporated under the laws of Costa Rica.
The operator may amend these Terms, including all documents referred to or linked in them, at any time. Customers should consult this page regularly. An amendment is binding and takes effect on publication. A Customer who objects to an amendment must stop using the Service immediately; continued use after publication signifies acceptance. Bets that have not been settled before an amendment takes effect remain governed by the earlier Terms. 3. Obligations of the Customer The Customer confirms that, whenever the Website is visited and the Service used:
3.1. The Customer is over 18, or over the age at which gambling is lawful under the law applicable to the Customer. Proof of age may be requested at any time.
3.2. The Customer has the legal capacity to conclude a binding agreement and, lacking it, must not visit the Website or use the Service.
3.3. The Customer resides in a jurisdiction where gambling is permitted and not in a country that prohibits online gambling for its residents or for persons within it. It is the Customer's sole responsibility to ensure that use of the Service is lawful.
3.4. The Customer will not use a VPN, proxy or comparable service or device that conceals or manipulates the real location.
3.5. The Customer is the authorised holder of every payment method used.
3.6. The Customer will make all payments in good faith and will not attempt to reverse a payment or cause a third party to do so.
3.7. Placing bets may result in the loss of part or all of the money deposited, for which the Customer is fully responsible.
3.8. The Customer will not place a bet on the basis of information obtained in breach of a statute in force in the country where the bet was placed.
3.9. The Customer acts solely on their own behalf as a private individual and not on behalf of another party or for commercial purposes.
3.10. The Customer will not attempt, in bad faith, to manipulate any market or other element of the Service, nor act in a way that harms the integrity of the Service or of the operator.
3.11. The Customer will in general act in good faith towards the operator at all times and for every bet placed through the Service.
3.12. Neither the Customer nor, where applicable, the Customer's employees, employers, agents or relatives are registered in the Affiliate programme. 4. Restricted use 4.1. The Service must not be used:
4.1.1. By a person under 18 (or under the age of majority under the applicable law), by a person without legal capacity to enter a binding agreement, or by a person acting as an agent or otherwise on behalf of a person under 18 (or under the age of majority);
4.1.2. By a resident of a country that prohibits online gambling for its residents or for persons within it.
4.1.3. By a resident of, or from within, any of these countries: Austria, France and its territories, Germany, the Netherlands and its territories, Spain, the Union of Comoros, the United Kingdom, the USA and its territories, every country on the FATF blacklist and any other jurisdiction that the Anjouan Offshore Financial Authority deems prohibited.
4.1.4. In order to collect nicknames, email addresses or other information of other Customers by any means, such as spam, unsolicited email or the unauthorised framing of or linking to the Service;
4.1.5. In order to disrupt, or unduly affect or influence, the activities of other Customers or the operation of the Service;
4.1.6. In order to promote unsolicited advertising, affiliate links or other solicitation, which may be removed without notice;
4.1.7. In any manner that, in the operator's reasonable opinion, may constitute an attempt (i) to cheat the Service or another Customer or (ii) to collude with another Customer to obtain a dishonest advantage;
4.1.8. In order to scrape the odds or infringe Intellectual Property Rights; or
4.1.9. For any unlawful purpose.
4.2. An Account may not be sold or transferred to a third party, and a player account may not be acquired from a third party.
4.3. Funds may not be transferred between player accounts in any manner.
4.4. If the Service is used for unauthorised purposes the operator may close the Account immediately by written notice and, in certain circumstances, bring legal proceedings.
4.5. Employees of the Company, of its licensees, distributors, wholesalers, subsidiaries, advertising, promotional and other agencies, media partners, contractors and retailers, and their immediate family members, may not play for real money without the prior consent of the Company Director or CEO. If this is discovered, the Account will be closed immediately and all bonuses and winnings forfeited.
The Customer agrees that, whenever the Service is used:
5.1. The operator may refuse any registration application at its sole discretion and is not obliged to give a reason.
5.2. Before using the Service the Customer must personally complete the registration form and read and accept these Terms. To bet or to withdraw winnings, the Customer may be required to become verified, which includes passing certain checks. The operator may require valid proof of identity and any other document it considers necessary, including a photo ID (a copy of a passport, driving licence or national identity card) and a recent utility bill showing name and address as proof of residence. Wagering may be suspended and Account options restricted until the information is received. This procedure follows the applicable gaming regulation and anti-money-laundering requirements. The Account must be funded with the payment methods listed in the payment section of the Website.
5.3. The Customer must provide accurate contact details, including a valid email address (the "Registered Email Address"), and keep them accurate. Failure to do so may mean that important notices, including changes to these Terms, are not received. The operator identifies and communicates with Customers through the Registered Email Address; each Customer must maintain an active and unique email account, supply the correct address and report any change. Each Customer is wholly responsible for the security of the Registered Email Address and for preventing its use by third parties. The Company is not liable for any damage or loss alleged to result from communication through that address. A Customer without an address reachable by the Company will be suspended until one is provided. Where false or inaccurate personal information is supplied intentionally, the Account will be suspended immediately by written notice, and legal action may be taken or the relevant authorities informed.
5.4. Only one Account may be registered. An Account is subject to immediate closure if the Customer is found to hold several, including through representatives, relatives, associates, affiliates, related or connected persons or third parties acting on the Customer's behalf.
5.5. To establish financial standing and confirm identity, the operator may request further personal information, such as full name, or use any third-party information provider it considers necessary; any additional information so obtained will be disclosed to the Customer. 5.6. The password must be kept confidential. Provided that the requested Account information has been correctly supplied, the operator may assume that bets, deposits and withdrawals were made by the Customer. The password should be changed regularly and never disclosed; its protection is the Customer's responsibility, at the Customer's sole risk and expense. The Customer may log out at the end of each session. Any suspected misuse, hacking of the Account or discovery of the password by a third party, and any hacking of the Registered Email Address, must be reported immediately; further information or documents may then be requested to verify identity. The Account will be suspended once the incident is known. Until then the Customer is responsible for all activity on the Account, including access by third parties, whether or not authorised.
5.7. Content or information from the Service must not be passed to another Customer or any other party by screen capture or a similar method, nor displayed in a frame or in any manner different from the way it would appear if the URL of the Service were typed into the browser.
5.8. On registration the Customer may use all currencies available on the Website, which will be the currencies of deposits, withdrawals and bets. Some payment methods do not process every currency; a processing currency is then displayed together with a conversion calculator.
5.9. The operator has no obligation to open an Account; the sign-up page is merely an invitation to treat. Whether to proceed is entirely at its discretion, and a refusal need not be explained.
5.10. After receiving an application the operator may request further information or documents in order to comply with its regulatory and legal obligations.
6.1. An Account may use several currencies; balances and transactions then appear in the currency of the transaction.
6.2. No credit is given for the use of the Service.
6.3. The operator may close or suspend an Account if the Customer does not, or is reasonably believed not to, comply with these Terms, in order to protect the integrity or fairness of the Service, or on other reasonable grounds, and cannot always give prior notice. If an Account is closed or suspended for non-compliance, bets may be cancelled or voided and money in the Account, including deposits, withheld.
6.4. Any Account may be closed or suspended without prior notice and the funds returned. Contractual obligations already matured will be honoured.
6.5. Any wager may be refused, restricted, cancelled or limited at any time and for any reason, including a bet believed to have been placed fraudulently to circumvent betting limits or system rules.
6.6. An amount credited by mistake remains the property of the operator, who will notify the Customer upon discovery and withdraw it from the Account.
6.7. If an Account becomes overdrawn the Customer owes the overdrawn amount.
6.8. The Customer must report any error on the Account as soon as it is noticed.
6.9. Betting is purely entertainment and should cease when it is no longer enjoyable; nothing should be wagered that cannot be afforded. A Customer who feels that control has been lost may self-exclude by sending a message to Customer Support from the Registered Email Address stating that they wish to SELF-EXCLUDE; the request takes effect within 24 hours of receipt. The Account is then disabled until further notice and login is not possible.
6.10. An Account may not be transferred, sold or pledged to another person. This prohibition extends to any asset of value, including ownership of accounts, winnings, deposits, bets and any rights or claims relating to them, whether legal, commercial or otherwise, and includes without limitation encumbrance, pledging, assignment, usufruct, trading, brokering, hypothecation and gifting, with a fiduciary or any other third party, company, natural or legal person, foundation or association in any form
6.11. A Customer wishing to close the Account should send an email from the Registered Email Address to Customer Support through the links on the Website.
7.1. Deposits should be made from an account, payment system or credit card registered in the Customer's own name. A deposit in another currency is converted at the daily exchange rate of oanda.com or at the prevailing rate of the operator's bank or payment processor. Some payment systems apply additional exchange fees, which are deducted from the deposit.
7.2. Fees and charges may apply to deposits and withdrawals and are shown on the Website. In most cases the operator absorbs transaction fees on deposits to the Lucky Boom Account; the Customer bears any bank charges incurred.
7.3. The Company is not a financial institution and uses third-party electronic payment processors for credit and debit card deposits. An Account is credited only upon receipt of an approval and authorisation code from the card issuer; without it, the funds are not credited.
7.4. The Customer agrees to pay in full all amounts due to the operator or to payment providers and not to make charge-backs or otherwise reverse any deposit. In such a case the Customer will refund and compensate the operator for the unpaid deposit and for the expenses of collecting it, and winnings from wagers made with charged-back funds are forfeited. The player account is not a bank account and is not guaranteed, insured or protected by any deposit or banking insurance system in any jurisdiction; it bears no interest.
7.5. A Customer who accepts a promotional or bonus offer by entering a bonus code with a deposit agrees to the Terms of Bonuses and the terms of the specific bonus.
7.6. Funds originating from criminal, illegal or unauthorised activity must not be deposited.
7.7. When depositing by credit card, the Customer is advised to keep a copy of the transaction records and of these Terms.
7.8. Internet gambling may be illegal in the Customer's jurisdiction, in which case the payment card may not be used to deposit on this site. The Customer must know the law on online gambling in the country of residence.
8.1. Unused and cleared funds may be withdrawn by submitting a withdrawal request in accordance with the withdrawal conditions. The minimum withdrawal per transaction is €10 (or the equivalent in another currency), except on closure of the Account, when the whole balance may be withdrawn.
8.2. No withdrawal commission applies if the deposit has been wagered at least once. Otherwise a fee of 8%, with a minimum of 4 euro (or the equivalent in the Account currency), may be deducted to combat money laundering.
8.3. Before a withdrawal is approved the operator may request a photo ID, confirmation of address or further verification (a selfie, a verification call and similar), and may verify identity at any time during the relationship.
8.4. Withdrawals must be made to the debit card, credit card, bank account or payment method originally used to fund the Account. The operator may at its discretion permit another method, always subject to additional security checks.
8.5. A Customer whose account is inaccessible, dormant, locked or closed should contact Customer Service.
8.6. Where the balance is at least ten times the total deposits, withdrawals are limited to €5,000 (or the currency equivalent) a month; in other cases the maximum is €10,000 a month.
8.7. Successful processing of a withdrawal or refund cannot be guaranteed where the restricted-use rules of Clauses 3.3 and 4 have been breached.
9.1. The Customer is fully responsible for all amounts owed. Payments must be made in good faith and must not be reversed, or caused to be reversed by a third party, to avoid a liability properly incurred. The Customer will reimburse the operator for every charge-back, denial or reversal and for any resulting loss, and an administration fee of €50, or the currency equivalent, may be charged for each.
9.2. The operator may use third-party electronic payment processors or merchant banks, and the Customer agrees to be bound by their terms provided that they are brought to the Customer's attention and do not conflict with these Terms.
9.3. All transactions may be checked to prevent money laundering and terrorist financing, and suspicious transactions will be reported to the relevant authority.
10.1. If an error or malfunction occurs in the system or processes, all bets are void. The Customer must report any error without delay. The operator is not liable to the Customer or any third party for direct or indirect costs, expenses, losses or claims resulting from communication or system errors, bugs or viruses, or from payments made as a result of a defect in the Service, and may void the games and bets concerned and take any other action to correct the error.
10.2. Every effort is made to avoid errors in posting bookmaker lines. If, through human error or system problems, a bet is accepted at odds materially different from those generally available at the time, or clearly incorrect given the chance of the event occurring, the wager may be cancelled or voided, as may a wager made after an event has started.
10.3. The operator may recover any overpaid amount and adjust the Account to rectify a mistake, such as an incorrect price or a wrongly entered result. If the Account holds insufficient funds, payment of the outstanding amount relating to erroneous bets may be demanded, and pending plays may be cancelled, reduced or deleted whether or not they were placed with funds resulting from the error.
11.1. The winner of an event is determined on the date of settlement, and protested or overturned decisions are not recognised for wagering purposes.
11.2. Posted results are final after 72 hours and no queries are entertained thereafter. Within 72 hours of posting, results are reset or corrected only because of human error, system error or a mistake of the source of results.
11.3. If the governing body of a match overturns the result for any reason within the payout period, all money is refunded. 11.4. If a game is drawn and a draw option was offered, all stakes on a team to win or lose are lost. If no draw option was offered, everyone is refunded on a draw, and if none was available, extra time counts, if played.
11.5. If a result cannot be validated, for instance because the feed broadcasting the event is interrupted and cannot be verified from another source, the wagers on that event may at the operator's election be deemed invalid and refunded.
11.6. Minimum and maximum wagers on all events are determined by the operator and may change without prior written notice, and limits may be adjusted on individual Accounts.
11.7. Customers are solely responsible for their own transactions. A completed transaction cannot be changed. The operator takes no responsibility for missing or duplicate wagers and will not consider discrepancy requests on that ground. Customers may review their transactions in the My Account section after each session to make sure that all requested wagers were accepted.
11.8. A matchup stands as long as the two teams are correct, regardless of the league heading under which it appears. 11.9. The start dates and times displayed for eSport matches are indicative only and not guaranteed. If a match is suspended or postponed and not resumed within 72 hours of the actual scheduled start, it has no action and wagers are refunded, except wagers on whether a team or player advances in, or wins, a tournament, which stand regardless.
11.10. If an event is posted with an incorrect date, all wagers stand according to the date announced by the governing body.
11.11. If a team uses stand-ins the result remains valid, the use of stand-ins being the team's choice.
11.12. The Company may remove events, markets and other products from the Website.
11.13. A detailed explanation of the sports betting rules appears on a separate page: SPORTS BETTING RULES
12.1. Communications and notices from the Customer under these Terms are to be sent through the Customer Support form on the Website.
12.2. Unless otherwise specified, communications and notices from the operator are posted on the Website or sent to the Registered Email Address, the method being in its sole discretion.
12.3. All communications and notices from either party must be in writing, in English, and sent to or from the Registered Email Address.
12.4. From time to time the operator may send emails with information about betting, promotional offers and other news from Lucky Boom. The Customer agrees to receive them upon accepting these Terms at registration and may opt out at any time by writing to Customer Support.
The operator is not liable for any failure or delay in providing the Service caused by an event of Force Majeure that could reasonably be considered beyond its control despite reasonable preventive measures, including an act of God, a trade or labour dispute, a power cut, an act, failure or omission of a government or authority, an obstruction or failure of telecommunication services, or any other delay or failure caused by a third party, nor for any resulting loss or damage. In such an event the Service may be cancelled or suspended without liability.
14.1. TO THE EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT COMPENSATE THE CUSTOMER FOR ANY REASONABLY FORESEEABLE LOSS OR DAMAGE, DIRECT OR INDIRECT, ARISING FROM A FAILURE TO PERFORM ITS OBLIGATIONS UNDER THESE TERMS, UNLESS IT BREACHES A DUTY IMPOSED BY LAW (INCLUDING DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE); AND EVEN THEN IT IS NOT LIABLE IF THE FAILURE IS ATTRIBUTABLE TO (I) THE CUSTOMER'S OWN FAULT, (II) A THIRD PARTY UNCONNECTED WITH THE PERFORMANCE OF THESE TERMS, SUCH AS NETWORK PERFORMANCE, CONGESTION, CONNECTIVITY OR THE CUSTOMER'S EQUIPMENT, OR (III) ANY OTHER EVENT THAT NEITHER THE OPERATOR NOR ITS SUPPLIERS COULD HAVE FORESEEN OR PREVENTED WITH REASONABLE CARE. THE SERVICE BEING FOR CONSUMER USE ONLY, THE OPERATOR IS NOT LIABLE FOR BUSINESS LOSSES OF ANY KIND.
14.2. IF THE OPERATOR IS HELD LIABLE FOR ANY EVENT UNDER THESE TERMS, ITS TOTAL LIABILITY SHALL NOT EXCEED THE LOWER OF (A) THE VALUE OF THE BETS PLACED THROUGH THE ACCOUNT ON THE RELEVANT BET, WAGER OR PRODUCT AND (B) EUR €500 IN AGGREGATE.
14.3. THE CUSTOMER IS STRONGLY ADVISED (I) TO VERIFY BEFORE USE THAT THE SERVICE IS SUITABLE AND COMPATIBLE WITH THEIR EQUIPMENT AND (II) TO TAKE REASONABLE PRECAUTIONS AGAINST HARMFUL PROGRAMS OR DEVICES, INCLUDING ANTI-VIRUS SOFTWARE.
Lucky Boom aims to provide an excellent and enjoyable gaming experience and recognises its responsibility to prevent problem gambling. All players are advised to observe the following and not to gamble irresponsibly:
Play for entertainment and not to make money.
Avoid chasing losses.
Set limits for yourself.
Do not allow gambling to interfere with daily responsibilities.
Never gamble unless you can afford to lose.
Take breaks.
Consider the questions below. If most answers are YES, action is advised to prevent gambling from harming your life:
Does gambling affect your work?
Has gambling led to arguments with family or friends?
Do you always return to win back losses?
Have you borrowed money to gamble?
Do you regard gambling as a source of income?
Do you find it hard to limit your gambling?
The following reputable organisations support people with gambling problems and can be contacted at any time:
Gamblers Anonymous
Gambling Therapy
GamCare
Players concerned about their gambling are advised to take a break by excluding themselves from their gaming account. Self-exclusion locks the account for a minimum of 6 months, and no promotional material is sent.
Customer Support can be contacted at any time to arrange this. A 7-day cooling-off period is also available. Players are advised to contact every other gambling site where they hold an account and request self-exclusion there too.
Players must have reached the legal gambling age in their jurisdiction (at least 18) to play at luckyboom.com, are responsible for knowing the age restriction where they live and play, and must confirm their eligibility when creating an account. Parents are advised to:
Protect computers, phones and tablets with a password.
Not leave a device unattended while logged in to an account.
Keep account details and payment cards out of reach of children.
Not save passwords on a computer, but write them down and keep them out of reach.
Install filtering software (such as Net Nanny) to prevent minors from reaching unsuitable sites.
16.1. If the operator suspects, or is notified, that the Customer is under 18 (or under the age of majority under the applicable law), or was when any bet was placed through the Service, the Account will be suspended (locked) so that no further bets or withdrawals can be made. The operator will investigate, including whether the Customer bet as an agent for, or on behalf of, a person under that age. If it is found that the Customer (a) is currently, (b) was at the relevant time below that age, or (c) bet as an agent for or at the behest of a person below it:
all winnings currently in, or due to be credited to, the Account will be retained;
all winnings obtained through the Service while under age must be paid to the operator on demand, failing which all costs of recovery will be pursued; and/or
any money in the Account that is not winnings will be returned or retained until the Customer turns 18, at the operator's sole discretion, and payment transaction fees, including fees on deposits that the operator covered, may be deducted from the amount returned.
16.2. This condition also applies to a Customer over 18 who bets in a jurisdiction that sets a higher legal minimum age and is below it.
16.3. If a breach of this Clause is suspected, or an attempt to rely on it for a fraudulent purpose, the operator may take any action necessary to investigate, including informing law-enforcement agencies.
The operator will seek criminal and contractual sanctions against any Customer involved in fraud, dishonesty or criminal acts and will withhold payment where they are suspected. The Customer indemnifies the operator and must pay on demand all costs, charges and losses sustained (including direct, indirect and consequential losses, loss of profit, of business and of reputation) arising directly or indirectly from the Customer's fraud, dishonesty or criminal act.
18.1. Any unauthorised use of the name and logo may result in legal action.
18.2. As between the parties, the operator is the sole owner of the rights in the Service, its technology, software and business systems (the "Systems") and its odds. The personal profile may not be used for commercial gain (for example by selling a status update to an advertiser), and a nickname may be removed or reclaimed where this is considered appropriate.
18.3. The URL, trademarks, trade names, trade dress and logos (the "Marks") and the odds may not be used with any product or service that is not the operator's, in any manner likely to cause confusion, or to disparage it.
18.4. Except as expressly provided, neither the operator nor its licensors grant any express or implied right, licence, title or interest in the Systems or the Marks, all of which are retained. The Customer agrees not to use any automatic or manual device to monitor or copy pages or content within the Service; unauthorised use or reproduction may result in legal action.
19.1. Subject to these Terms and compliance with them, the Customer is granted a non-exclusive, limited, non-transferable and non-sublicensable licence to access and use the Service for personal, non-commercial purposes only, which ends when the agreement ends.
19.2. Save for the Customer's own content, the Service, its content and its software may not under any circumstances be modified, published, transmitted, transferred, sold, reproduced, uploaded, posted, distributed, performed, displayed, used to create derivative works or otherwise exploited, except as expressly permitted. No information or content may be modified, altered, merged with other data or published in any form, including screen or database scraping and any other activity intended to collect, store, reorganise or manipulate it.
19.3. Non-compliance with this Clause may also violate intellectual property and other proprietary rights of the operator or third parties and may give rise to civil liability or criminal prosecution.
20.1. For the protection of the Customer and all other Customers, posting any content on the Service, and any conduct in connection with it or with the Service, that is unlawful, inappropriate or undesirable in any way is strictly prohibited ("Prohibited Behaviour").
20.2. If a Customer engages in Prohibited Behaviour, or the operator determines in its sole discretion that they do, the Account or access to the Service may be terminated immediately without notice, and legal action may be taken by another Customer, a third party, enforcement authorities or the operator.
20.3. Prohibited Behaviour includes, without limitation, accessing or using the Service to: promote or share information known to be false, misleading or unlawful; carry on unlawful activity, such as furthering criminal enterprise, violating the privacy or rights of another Customer or third party, or creating or spreading computer viruses; harm minors in any way; transmit or make available unlawful, harmful, threatening, abusive, tortious, defamatory, vulgar, obscene, lewd, violent, hateful or racially, ethnically or otherwise objectionable content; transmit content that the user has no right to make available under any law or contractual or fiduciary relationship, including content that infringes a third party's copyright, trademark or other intellectual property; transmit content containing a software virus or other code (including HTML) designed to interrupt, destroy or alter the functionality of the Service, its presentation or any other website, software or hardware; interfere with, disrupt or reverse engineer the Service, including intercepting, emulating or redirecting the communication protocols, creating or using cheats, mods or hacks, or using software that intercepts or collects information from or through the Service; retrieve or index information using any robot, spider or other automated mechanism; take part in any activity that, in the sole and unfettered discretion of the operator, results or may result in another Customer being defrauded or scammed; transmit unsolicited or unauthorised advertising or mass mailing, such as junk mail, instant messaging, "spim", "spam", chain letters, pyramid schemes or other solicitations; create Accounts by automated means or under false or fraudulent pretences; impersonate another Customer or any third party; or do anything else that the operator reasonably considers contrary to its business principles. The list is not exhaustive and may be modified at any time. The operator may investigate and take all action it deems appropriate or necessary, including deleting postings and terminating the Account, and act against any Customer or third party who directly or indirectly engages in, or knowingly permits others to engage in, Prohibited Behaviour, with or without notice.
The Service may contain links to third-party websites that the operator does not maintain, is not related to and cannot control. Such links are provided only for convenience and are not investigated, monitored or checked for accuracy or completeness; they imply no endorsement of, or affiliation with, the websites, their content or their owners. The operator has no control over or responsibility for their availability, accuracy, completeness, accessibility or usefulness. On visiting such websites the usual precautions should be taken, including reviewing their privacy policy and terms of use.
22.1. Concerns or questions about these Terms should be addressed to Customer Service through the links on the Website, using the Registered Email Address in all communication.
22.2. NOTWITHSTANDING THE ABOVE, THE OPERATOR ACCEPTS NO LIABILITY TO THE CUSTOMER OR TO ANY THIRD PARTY IN RESPONDING TO A COMPLAINT OR IN ANY ACTION TAKEN IN CONNECTION WITH IT.
22.3. A Customer who is dissatisfied with the settlement of a bet should give details to Customer Service. The operator will use reasonable endeavours to respond within a few days and in any event intends to respond to all such queries within 28 days of receipt.
22.4. Disputes must be lodged within three (3) days of the date on which the wager was decided; no claims will be honoured afterwards. The Customer is solely responsible for their Account transactions.
22.5. In the event of a dispute, Customer Service will attempt to reach an agreed solution; if it cannot, the matter will be escalated to management.
22.6. If all efforts to resolve a dispute to the Customer's satisfaction have failed, the Customer has the right to have it settled by arbitration.
The Customer may not assign these Terms or any right or obligation under them without the operator's prior written consent, which will not be unreasonably withheld. The operator may, without consent, assign all or part of its rights and obligations to a third party able to provide a service of substantially similar quality, by posting written notice on the Service.
If a competent authority finds any provision of these Terms unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable in line with the intention of the original text, and the remaining provisions remain valid and enforceable.
Without limiting other remedies, the operator may suspend or terminate the Account and refuse to continue providing the Service, without prior notice, if in its reasonable opinion the Customer breaches a material term; notice of the action taken will, however, be promptly provided.
26.1. Term. These Terms remain in full force while the Customer accesses or uses the Service or is a Customer or visitor of the Website, and survive termination of the Account for any reason.
26.2. Interpretation. The singular includes the plural and vice versa; the masculine includes the feminine and neuter and vice versa; and references to persons include individuals, partnerships, associations, trusts, unincorporated organisations and corporations.
26.3. Waiver. No waiver by the operator of a breach or threatened breach, by conduct or otherwise, is effective or binding unless in writing and duly signed, and unless stated otherwise it is limited to the specific breach waived. A failure to enforce a term at any time is not a waiver of it or of the right to enforce it at another time.
26.4. Acknowledgement. By accessing or using the Service hereafter, the Customer acknowledges having read, understood and agreed to every paragraph of these Terms and irrevocably waives any future argument, claim, demand or proceeding to the contrary.
26.5. Language. If the English version of these rules differs from any other language version, the English version is deemed correct.
26.6. Governing law. These Terms are governed exclusively by the law in force in the state of Anjouan in the Union of Comoros.
26.7. Entire agreement. These Terms are the entire agreement between the Customer and the operator regarding access to and use of the Service and supersede all prior agreements and communications, oral or written, on the subject.
